I thought LodSys and Google were going to work this out between themselves. I guess LodSys thought their odds of getting the cash they wanted were not as great doing that as they'd like. (probably because Google's patent thicket is too dense, which would require them to cross-license or face counter-suits)
So now they're hitting developers.
Cory: May I strongly suggest you contact the EFF? Posting to slashdot/techdirt/boingboing would probably be a good idea as well. From the prior cases I've seen most patent-trolls will fold when faced with substantial-enough bad PR, so if you can a major news site to pay attention you might be able to put pressure back on LodSys and force a settlement.
(contacting the EFF may well help you find decent, and less expensive, legal help as well)

Didn't ebay already do that years ago???

Ya, pretty sure Ebay had a Buy It now before the year 2000 but my memory is fuzzy. Their patent is a joke anyway much like the original Tivo patent they made so much fuss over a few years back. Amazingly we had the ability to do that sort of thing on computers years before it too and I think they screwed Dish Network (whether that company is evil or not is largely irrelevant) quite hard with them. From everything I've seen of this it's like they've patented a hyperlink. Whoopedy doo.
I really need to rush out and patent this new idea I had called "Breathing." I think I can make a fortune with it. It's a lifesaver.

To late dude, I already patented a "built in two phase device that alternates between: the ingestion and processing of resources and the removal of waste resources generated from the initial process. The device will be multifunctional and allow for recreational activities as the user wishes. These activities may allow for the partial ingestion of other devices or allow the user to communicate with similar devices in an attempt to create feedback."
