Keep in mind that you can surrender to a smuggler and regardless of reputation, you will be arrested and rep will go up to -5

But if you're not in a low rep to be imprisoned or anything, then they'll just loot you like a pirate.

How low of rep when you surrender? I think it's like 0--10 they'll loot you, or you attack with positive/neutral rep and then surrender they'll loot you. Any lower and it's imprisonment.
