I'm so confused when texas powers asks you to capture a fugitive and it doesn't give you the option please help

Take out the guards. The switch to melee (click weapons to switch between 2 weapons). Go next to fugitive and attack. Once MP is deleted he goes down and you exit the battle successfully.
Helps to have attack gloves like the Stunna or Steel Knuckles.
