Well man oh man I did not realize that. So legality is a totally different system which, I'm guessing, smugglers deal with?

Yes, Smugglers will regularly work around legality. The demand/supply system splits long Law -- legal goods in the Exchange, illegal ones in the Blackmarkets.

Well I'll be damned. Looks like smuggling might just be a ton of fun.
So, since we seem to have smuggling contacts and smuggling economies, will smuggling in the black market be non-faction specific? Meaning, if I am in good with the smugglers and have strong contacts/rep with them, will I have access to black markets on planets that I don't have much rep with?

Interesting question.
Zones define Law Level. Law Level bans Trade Resources. I'm sure you've seen planets where supply is missing due to Law level, or places you cannot sell goods because they are illegal. Illegal goods are simply filtered from Supply.
Access to the Black Market is via a Contact in that Zone. There isn't a Faction of Smugglers. This is intended to be a complimentary feature to Trade Permits.
Even if you have a Level 4 Trade Permit with De Valtos, if you visit a Law Level 9 Industrial Zone, you cannot buy Narcotic Spice. But you could access a Black Market, via your De Valtos Smuggler, and purchase Narcotic Spice by the tonne. You've got the necessary permits, so even if De Valtos searched your ship you're fine -- they don't know you purchased the cargo illegally. Talents like Forged Permit can be used here as well.
You could still purchase that Narcotic Spice from a Smuggler without the Trade Permit -- but it would cost a little more.
The scheme is the higher economy places tend to have better governments. Bigger population places with better governments have higher law levels, and ban more trade goods. So the very best place to buy Narcotic Spice is also a place that it is probably (not 100%, but probably) illegal.
Likewise, the Luxury Population place that REALLY wants tonnes of Narcotic Spice, if it is a really high population place ... blah blah ... high law is likely and selling the Narcotic Spice there requires a Black Market access.
Now, there will be other ways to get to a Black Market ... without a Contact. Talents. Screw it up, and you'll end up fighting a Crew combat with FDF tho.
