How do I make sure I capture the guy witout destroying him or his ship?

I'm pretty sure the only guaranteed way to do it is to board it: Close range, possibly gun the crew, then board. Don't sit back and torpedo.

I just gun the engines then enslave and depart

Ditto, I'm pretty partial to spraying the engines, torpedoes are a guaranteed way to end up frying your mark. usually I've got pretty bad odds with spraying the crew as well.

Do you have to enslave the crew in order to "capture" your target?

Just Depart without killing everyone and the Captain will take his prisoner with him.
The next release should include some fixes to the UI to make this much more obvious.
