Trese Brothers Fan Fiction Policy The Trese Brothers’ policy on fan fiction and all other derivative works is as follows: - A derivative work is a work based upon one or more preexisting works that includes major, copyright-protected elements of an original, underlying work;
- The characters, worlds and stories created by the Trese Brothers and depicted in Trese Brothers’ games are original elements/underlying work. Any fan fiction, fan art or other fan creation using these original elements is a derivative work;
- It is permissible to create a derivative work for noncommercial purposes only;
- A noncommercial derivative work may be posted to Trese Brothers’ online communities, other online communities or distributed offline;
- It is impermissible to create or distribute a derivative work for any commercial purpose without the express written consent of Trese Brothers;
- The Trese Brothers retain all rights with regards to their intellectual property (including, but not limited to, the characters, worlds and stories) and expressly reserve the right to prohibit the distribution of any derivative work or demand the removal of any derivative work from any website at their sole discretion;
